Online Consignor Requirements

Approved online consignors are responsible for providing accurate information about their items and for making sold items available to the buyer. Please answer the following questions.

Online Consignor Agreement

Please review the following agreement carefully. By accepting these terms and signing below, you are entering into an agreement with BC Auctions LLC governing your participation as an approved online consignor.

BC Auctions Online Consignor Agreement

1. Approval & Consignment Acceptance
Submitting this application does not automatically approve you as an online consignor. Once approved, you may submit items for consideration by BC Auctions. BC Auctions may accept or reject any item and will determine the auction in which an accepted item will be offered.

2. Ownership & Right to Sell
You certify that you own each item you submit or have legal authority to sell it. You must disclose any lien, loan, security interest, or other claim against an item. You are responsible for providing any title or ownership documents requested by BC Auctions.

3. Accepted Items
Once BC Auctions accepts an item for consignment, you agree not to sell, transfer, withdraw, or otherwise dispose of the item outside the BC Auctions/GavelWay auction process without written approval from BC Auctions. Unless an approved reserve has been established, accepted items will be sold to the highest bidder.

4. Photos, Videos & Descriptions
You are responsible for providing clear, accurate photos and/or video and an honest description of each item. Known defects, damage, missing parts, mechanical problems, or other material issues must be disclosed. BC Auctions may request additional information or media and may edit submitted descriptions for clarity, formatting, and marketing without assuming responsibility for the accuracy of information supplied by the consignor.

5. Commission, Fees & Auction Assignment
When an item is accepted, BC Auctions will provide the auction assignment, applicable commission rate, fees, approved reserve (if any), and other important consignment information. By allowing the accepted item to proceed to auction, you agree to those consignment terms.

6. Pickup, Shipping & Loading
You are responsible for making sold items available within the time specified by BC Auctions. Depending on the item and auction, you may be required to ship the item, make it available for buyer pickup, or deliver it to a location designated by BC Auctions. When equipment is necessary for loading, you are responsible for providing or arranging appropriate loading assistance unless other arrangements have been approved by BC Auctions.

7. Payment & Settlement

Buyer payments will be handled by BC Auctions. Applicable commissions, fees, expenses, refunds, or other authorized charges will be deducted from the consignor's proceeds. Settlement will normally be made within 30 days of the auction in accordance with Kentucky law. BC Auctions may hold proceeds in escrow when necessary to complete the transaction, including when required title or ownership documents have not been provided, a lien or ownership issue remains unresolved, delivery or transfer of possession has not been completed, or another issue prevents completion of the sale. Funds held under these circumstances will remain in escrow until the issue is resolved and may be released as permitted by law.

8. Failure to Complete the Sale
If you withdraw an accepted item without authorization, sell it outside the auction, fail to make a sold item available, materially misrepresent an item, or otherwise fail to fulfill your obligations, you may be responsible for the commission that would have been earned, applicable expenses, refunds or costs resulting from the failure, and any withdrawal or breach fee disclosed by BC Auctions. Online consignor privileges may also be suspended or revoked.

9. Seller Responsibility
You remain responsible for the item and the accuracy of the information you provide until the transaction is completed. BC Auctions is not responsible for loss or damage to property remaining in the consignor's possession.

10. Agreement
By accepting these terms and signing this application, you acknowledge that you have read and understand this agreement and agree to follow BC Auctions' online consignment requirements. Electronic signatures and electronic acceptance of these terms will be treated as your agreement to them.
